Terms of Service (TOS)

Version 1.2 — Effective August 1, 2026

These Terms govern access to the FitDesk platform, operated by FitDesk (Société par Actions Simplifiée (SAS), RCS Montpellier 104 196 233), whose registered office is at 118 Rue des Roselières, 34970 Lattes, France.

FitDesk is a technological platform designed to facilitate management and monitoring between coaches and athletes. FitDesk is not a sports coaching provider, does not provide medical services, and is not a party to the contractual relationship between coaches and athletes.

Article 1 — Purpose and scope

These Terms define the conditions under which FitDesk makes the FitDesk platform (the "Platform") available, accessible from www.fitdesk.io and via its Android mobile application. They apply to any user holding an account, whether acting as a coach, an athlete or an organisation manager. The financial terms applicable to subscribing coaches are set out in separate Terms of Sale.

Article 2 — Definitions

  • Platform: the FitDesk software service, accessible via its website and its Android mobile application.
  • Coach: any professional using the Platform to manage and monitor athletes.
  • Athlete: any user invited or attached to a Coach or to an Organisation in order to benefit from monitoring.
  • Organisation: a professional structure (club, gym, practice) holding a dedicated space and bringing together members.
  • Manager: the user appointed to administer an Organisation, its members and its information, without access to the sports monitoring or health data of Athletes.
  • Account: the personal space created to access the Platform.
  • Content: all data, documents, messages, programmes and information transmitted through the Platform.
  • Assistant or "Milo": the conversational assistant embedded in the Platform (see Article 11).

Article 3 — Acceptance and successive versions

Accessing and using the Platform implies full and unreserved acceptance of these Terms. Certain categories of users may be asked to give express, time-stamped acceptance within the Platform; such acceptance is retained as evidence. The applicable version is the one in force on the date of connection, whose number and date appear in the header.

Article 4 — Description of the service

FitDesk enables, in particular: management of Coach, Athlete and Manager accounts as well as of Organisations; management of the Coach's client relationships, including prospect tracking; creation and monitoring of training programmes; design of meal plans; tracking of progress, performances and well-being reports; one-to-one or group messaging; assistance by a conversational assistant; management of the Coach's subscription and billing.

FitDesk acts exclusively as publisher and operator of a software platform and exercises no educational, sporting, medical or nutritional control over the content produced by Coaches.

Article 5 — Access to the Platform

The Platform is accessible from a web browser as well as from the FitDesk mobile application distributed on Google Play. Access requires the prior creation of an Account and the provision of accurate information.

FitDesk endeavours to keep the Platform accessible 24/7, without any obligation of result. Access may be temporarily suspended for maintenance, security or technical upgrades.

Article 6 — Account and access security

Users are solely responsible for keeping their credentials confidential. In addition to a password, the Platform offers passwordless authentication based on an access key ("passkey") registered on the user's device, of which the user has custody. Any suspected compromise must be reported without delay to contact@fitdesk.io.

Article 7 — Free trial

A seven (7) day free trial may be offered to the Coach upon creation of their Account. It allows the monitoring of a maximum of two (2) active athletes, without commitment or bank card details, and is limited to one use per Coach. At the end of the trial, absent subscription, features are restricted; the data entered is retained.

Article 8 — Role and responsibility of Coaches

The Coach acts under their sole responsibility. They represent that they hold the required skills and authorisations, that they use the Platform in accordance with their professional obligations, that they do not present FitDesk as the provider of their services, that they bear sole responsibility for the programmes, advice and content sent to Athletes — including where these were produced from a suggestion made by the Assistant — and that they obtain from their own clients the consents required by data protection law.

Article 9 — Role and responsibility of Athletes

Athletes use the Platform under their own responsibility and under that of their Coach. They undertake to provide truthful information, to comply with reasonable use of the service, to consult a healthcare professional where their condition requires it, and not to divert the Platform from its purpose. The programmes and recommendations offered in no way replace medical advice, a diagnosis or a treatment.

Article 10 — Organisations and Managers

A Coach or an Athlete may be attached to an Organisation. Such attachment entails the following consequences:

  • the Manager has access to the directory of Members and to attachment information. They have access neither to the sports monitoring nor to the health data of Athletes, nor to the content of exchanges between a Coach and their Athlete;
  • a Coach who is a Member of the Organisation may access the monitoring record of an Athlete of the same Organisation, including their health information, in order to ensure continuity of support, even where there is no direct relationship between them;
  • Members may be brought together in group conversations, in which their identity is visible to the other participants.

The Manager is responsible for the invitations they issue and ensures that they are entitled to attach a Member. The end of the attachment terminates, for the future, the accesses deriving from it.

Article 11 — The "Milo" conversational assistant

The Platform provides a conversational assistant based on language models supplied by a third-party provider established outside the European Union. It is used to suggest meals, compose exercises and answer support requests.

Users are informed that the content they type into a conversation, together with the history of that conversation, is transmitted to the language model provider. By contrast, no data from the user's record — health record, allergies, well-being reports, performances — is automatically transmitted to the Assistant. Messages are subject to a prior automated compliance check, conversations are stored temporarily and then deleted, and use may be subject to limits designed to preserve the availability of the service.

Content produced by the Assistant constitutes suggestions. It is neither medical advice, nor a diagnosis, nor a prescription, nor personalised dietary advice. It must be reviewed, adapted and validated by the professional who uses it, who remains solely responsible for it towards the Athlete.

Article 12 — Health, sports and nutrition data

Some content handled on the Platform may be particularly sensitive (physical condition, performances, injuries, diet, declared health status, how the user feels). Entering it is optional and based on the explicit consent of the data subject, which may be withdrawn at any time. FitDesk provides a technical infrastructure without medical or scientific validation of its content; it is for Coaches to ensure that the information and programmes transmitted are appropriate to the Athlete's situation.

Article 13 — Messaging and content exchanged

The Platform provides a messaging service allowing one-to-one exchanges, exchanges with support and group conversations. In a group conversation, the user's identity and messages are visible to all participants, who may include other Athletes monitored by the same Coach or other Members of the same Organisation. Each user remains responsible for the content they transmit.

Article 14 — Notifications and communications

The Platform sends the communications necessary for the operation of the service (confirmations, invitations, security alerts, account or subscription information) as well as follow-up messages triggered automatically by the user's activity (extended absence of connection, unvalidated session, sign-up anniversary). Users may object to these follow-up messages by writing to contact@fitdesk.io. Outreach communications sent to professionals always include a means of immediate unsubscription.

Article 15 — Prohibitions

Users are strictly prohibited from impairing the proper functioning of the Platform, impersonating a third party, distributing unlawful content, collecting the data of other users without authorisation, circumventing technical or commercial restrictions, using the Platform for spam or unauthorised outreach, and diverting the Assistant from its purpose — in particular by attempting to circumvent its safeguards or to extract its internal instructions.

Article 16 — Intellectual property

The Platform, its structure, interfaces, code, trade mark and databases remain the exclusive property of FitDesk or its licensors. No assignment of rights is granted. Each user remains the holder of the rights in their own Content, subject to the rights necessarily granted to FitDesk for hosting, backup, display and technical operation of the Platform.

Article 17 — Personal data

The processing of data is governed by the Privacy Policy, which forms an integral part of the contractual framework. Each Coach remains the data controller in respect of the data of their own clients and prospects.

Article 18 — Evidence and traceability

Computer records, event logs, time stamps, acceptance confirmations and action histories retained by FitDesk under reasonable security conditions may serve as evidence of the operations occurring on the Platform, unless proven otherwise.

Article 19 — Suspension and deletion of accounts

FitDesk may suspend, restrict or delete any Account in the event of breach of these Terms, fraud, failure to comply with applicable law, a security risk, non-payment, or a request from a competent authority. Except in an emergency, the user may be notified beforehand. The measure does not give rise to any compensation.

Article 20 — FitDesk's liability

FitDesk is bound by an obligation of means. It may not be held liable for decisions taken by Coaches, Athletes or Managers, for bodily injury or consequences related to sports practice, for the unsuitability of a programme or of a suggestion generated by the Assistant and taken up by a Coach, for data losses attributable to the user or to force majeure, for temporary interruptions of the service, or for content transmitted by users.

In any event, to the extent permitted by law, FitDesk's total liability may not exceed the sums actually received under the subscription of the Coach concerned during the twelve (12) months preceding the event giving rise to the damage.

Article 21 — External links and third-party services

The Platform may contain links or integrations to third-party services, in particular for hosting, payment, message delivery, distribution of the mobile application and supply of the language models used by the Assistant. FitDesk exercises no control over the content of third-party services accessible by link. The providers used by FitDesk are identified in the Privacy Policy.

Article 22 — Changes to the Platform and to the Terms

FitDesk may change the features and content of the Platform at any time, and may amend these Terms. Users are informed of substantial changes by any appropriate means; renewed acceptance may be requested before further use.

Article 23 — Term, mediation and governing law

These Terms apply throughout the use of the Platform, subject to those provisions intended by their nature to survive. If a provision were declared void, the others would remain in force.
