Terms of Service (TOS)
Version 1.1 — Effective June 1, 2026
These ToS govern access to the FitDesk platform, published by FitDesk (Simplified Joint-Stock Company (SAS), Montpellier Trade Register (RCS) 104 196 233), registered at 118 Rue des Roselières, 34970 Lattes, France.
Article 1 — Purpose and scope
These Terms define the conditions under which FitDesk makes the FitDesk platform available at www.fitdesk.io and via iOS and Android apps. Any access constitutes full acceptance of these Terms.
Article 2 — Service description
FitDesk is a SaaS platform for sports and nutrition professionals. Features include: client/prospect management (CRM), training programme creation, nutrition plans, progress tracking, coach-client messaging and billing management via Stripe.
Article 3 — Registration and user account
3.1 Eligibility — Registration is reserved for adult individuals acting professionally. The user warrants the accuracy of information provided.
3.2 Credentials — The user is responsible for keeping credentials confidential. Any use via their credentials is attributed to them. In case of compromise: a.machabert@fitdesk.io.
3.3 Free Trial — 7-day free trial, no commitment, no credit card required, limited to 5 clients. After this period the account is automatically restricted; data is retained.
Article 4 — Subscriptions and billing
4.1 Pricing Plans — Paid plans (Starter, Pro, Premium, Organisation) are described on the Pricing page. Prices in euros ex-VAT, billed monthly or annually.
4.2 Payment — Payments processed by Stripe. FitDesk does not store banking information.
4.3 Cancellation — Cancellation possible at any time from the account space, free of charge. Takes effect at end of the current period.
Article 5 — User obligations
The user agrees to use the Platform in accordance with its purpose and applicable laws, not to compromise its security, not to extract other users' data, to respect FitDesk's intellectual property rights, and to obtain necessary GDPR consents from their own clients.
Article 6 — Intellectual property
FitDesk holds all rights over the Platform (code, interface, trademark, databases). No licence is granted beyond the right of use for the Platform. Content created by the user belongs to them; they grant FitDesk a hosting licence limited to service provision.
Article 7 — Availability and maintenance
Target availability: 99.5% monthly. Maintenance interruptions may occur with prior notification. FitDesk does not guarantee uninterrupted availability.
Article 8 — Liability
FitDesk is not liable for sports or nutrition advice given by coaches, damage from non-compliant use, third-party interruptions, or data loss due to force majeure.
Article 9 — Personal data protection
Data processing is governed by the Privacy Policy at www.fitdesk.io. Each coach remains data controller for their own clients and must comply with GDPR.
Article 10 — Automated decision-making and profiling
FitDesk does not carry out any automated decision-making or profiling within the meaning of GDPR article 22 with respect to its users.
Article 11 — Amendments
FitDesk may amend these Terms with 30 days' email notice. Continued use after this period constitutes acceptance.
Article 12 — Mediation and dispute resolution
In the event of an unresolved dispute, the Customer may use the free consumer mediation service: Centre de Médiation et de Consommation des Conciliateurs de Justice (CM2C), 14 rue Saint-Jean, 75017 Paris — www.cm2c.net.
