General Terms of Sale
Version 1.1 — Effective June 1, 2026
These GTS apply to any subscription taken out with FitDesk (Simplified Joint-Stock Company (SAS), Montpellier Trade Register (RCS) 104 196 233), registered at 118 Rue des Roselières, 34970 Lattes, France.
Article 1 — Scope
These GTS govern the sale of FitDesk platform subscriptions between FitDesk ("the Seller") and any professional taking out a paid subscription ("the Customer"). They take precedence over any other Customer document.
Article 2 — Offers and pricing
Available plans (Starter, Pro, Premium, Organisation) and current prices are on www.fitdesk.io. Prices in euros ex-VAT; applicable VAT added at billing. Price changes communicated 30 days before next renewal.
Article 3 — Order and contract formation
Subscription completed online at www.fitdesk.io. Contract formed upon Stripe payment confirmation. Customer receives email confirmation.
Article 4 — Payment terms
4.1 Payment Methods — Payment by credit card (Visa, Mastercard, American Express) via Stripe. FitDesk does not hold or process banking data.
4.2 Automatic Renewal — Subscription renews automatically at chosen frequency until cancelled. In case of payment failure, FitDesk may suspend access after notification.
4.3 Invoicing — Invoice issued automatically at each renewal, accessible from the account space.
Article 5 — Right of withdrawal
Important : pursuant to French Consumer Code article L.221-28, the 14-day right of withdrawal does not apply to digital content contracts whose performance has begun with the consumer's agreement and express waiver.
As access is immediate upon subscription, the Customer expressly acknowledges waiving their right of withdrawal. For non-professional subscriptions, the Customer has 14 days to withdraw via a.machabert@fitdesk.io.
Article 6 — Cancellation
Cancellation at any time from the account space. Takes effect at end of the current period; no pro-rated refund unless legally required. FitDesk may terminate in case of serious uncorrected breach after 8 days' formal notice.
Article 7 — Legal guarantees — digital content and services
Pursuant to French ordinance n° 2021-1247 of 29 September 2021 (transposing EU directive 2019/770), the service benefits from the legal guarantee of conformity (French Consumer Code art. L.224-25-12 et seq.): FitDesk undertakes to provide a service conforming to the contract and to remedy any non-conformity without delay.
Article 8 — Liability
FitDesk's liability is limited to amounts received for the current subscription. FitDesk is not liable for indirect damages, loss of business or loss of profit.
Article 9 — Force majeure
Neither party is liable for failure to perform due to force majeure within the meaning of French Civil Code article 1218.
Article 10 — Mediation and dispute resolution
In the event of an unresolved dispute, the Customer may use the free consumer mediation service: Centre de Médiation et de Consommation des Conciliateurs de Justice (CM2C), 14 rue Saint-Jean, 75017 Paris — www.cm2c.net.
